NAC Travel International Student Recruitment Agency Terms and Conditions

This Agreement (the “Agreement”) is a legally binding contract between you (“the Client”) and NAC Travel International (“NAC”), a student recruitment agency based in Bedfordview, Johannesburg, South Africa. By using NAC’s services, you acknowledge and agree to be bound by the terms and conditions of this Agreement.

1. Service Fees and Deposits. NAC’s service fees are non-refundable. Parents, students, or sponsors may choose to pay a one-time, non-refundable fee of R6000 for assistance with enrolling in an educational institution or to pay a refundable deposit of R20,000. The R20,000 deposit will be refunded once the student completes their first term at the enrolled institution. If a student visa is denied, the R20,000 deposit is fully refundable.
2. Cancellation and Penalties. If a student drops out, discontinues, or cancels their studies after securing a student visa with the assistance of NAC, the student, parents, and sponsors will be responsible for paying a penalty fee of R20,000 to NAC. If a student cancels the application before the visa is approved due to personal reasons, a penalty of up to 50% of the deposit may apply.
3. Criminal Charges and Legal Fees. Any criminal charges filed against the student will be the responsibility of the student, parent, and/or sponsors to pay any legal fees. In the event that a student is charged with any criminal activity during the course of their studies, a penalty fee of R20,000 will be required to be paid to NAC.
4. Police Clearance and Medical Reports. All students will be required to produce a police clearance report upon lodging their application with NAC. Any medical conditions must be verified by a GP and medical and radiology reports must be submitted with the student’s application.
5. Flights, Accommodation, and Travel Insurance. If making their own arrangements for flights, accommodation, or travel insurance, students must provide proof of these arrangements to NAC or the relevant NAC Ambassador handling the student’s application. NAC only offers consultation services when booking flights and accommodation and the terms and conditions of each provider may vary.
6. Payments. All payments must be made to the official NAC bank account with the applicant’s full name as reference. NAC will not be held liable for payments made to personal accounts or other business accounts not associated with NAC. 7. Acceptance and Visa Guarantees. Using the services of NAC does not guarantee acceptance into a school, college, or university, nor does it guarantee a successful visa application. The right of admittance and the right to grant a visa lie solely at the discretion of the relevant educational institution and immigration office.
8. Consultancy Services. NAC acts strictly as a consultant and the terms and conditions of each educational institution may vary. Students must verify the terms and conditions of enrollment with each institution they enroll with. NAC does not guarantee any student work abroad opportunities or a job. While some educational institutions may offer internships, such agreements are made between the student and the institution and should not be expected as part of NAC’s services.
9. Termination of Services. NAC reserves the right to terminate its services to any student at any time for any reason.
10. Limitation of Liability. NAC shall not be liable for any damages arising from the use of its services.

11. Confidentiality. NAC will maintain the confidentiality of the Client’s personal information and will not disclose it to third parties without the Client’s prior written consent, unless required by law.
12. Governing Law. This Agreement shall be governed by the laws of the Republic of South Africa.
13. Entire Agreement. This Agreement constitutes the entire agreement between the Client and NAC and supersedes any prior agreements or understandings, whether written or oral. This Agreement may not be amended or modified except in writing signed by both parties.
14. Waiver. The failure of either party to exercise any right provided for in this Agreement shall not be deemed a waiver of any right.
15. Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Dispute Resolution. In the event of a dispute arising out of or in connection with this Agreement, the parties agree to attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, the parties agree to submit the dispute to mediation or arbitration in accordance with the rules of the International Chamber of Commerce or such other organization as the parties may agree upon.
17. Force Majeure. NAC shall not be liable for any failure or delay in performing its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, and governmental action.
18. Assignment. The Client may not assign or transfer its rights or obligations under this Agreement without the prior written consent of NAC. NAC may assign or transfer its rights and obligations under this Agreement without the prior written consent of the Client.
19. Third Party Beneficiaries. This Agreement is for the benefit of the parties only and does not create any rights or benefits for any third party.

20. Notices. Any notices required or permitted to be given under this Agreement shall be in writing and shall be delivered personally, sent by registered or certified mail, or by recognized overnight courier service to the parties at the addresses set forth below or to such other address as a party may designate in writing to the other party.

21. Survival. The provisions of this Agreement that by their nature should survive the termination of this Agreement shall survive such termination, including but not limited to the provisions regarding payment, confidentiality, and limitation of liability.

By using the services of NAC Travel International, you acknowledge that you have read and agree to be bound by the terms and conditions of this Agreement.

General Subscription Terms and Conditions

1. Subscription Period. The subscription period for all NAC Travel International subscription services is a minimum of 12 months. If a client wishes to cancel their subscription before the end of the 12-month period, they must pay the full cost of the first year’s subscription. If a client wishes to waive the R20,000 deposit required for subscription, they must subscribe for a minimum period of 3 years.
2. Cancellation. If a client cancels their subscription before the end of the 12-month period, they will be required to pay the full cost of the first year’s subscription. If a client wishes to cancel their subscription after the end of the 12-month period, they may do so by providing written notice at least 30 days prior to the end of the current subscription period.
3. Changes to Subscription Services. NAC Travel International reserves the right to make changes to the subscription services at any time. Any changes to the subscription services will be effective upon the posting of the modified terms on the NAC Travel International website. Continued use of the subscription services after any such changes shall constitute the client’s consent to such changes.
4. Limitation of Liability. NAC Travel International shall not be liable for any damages arising from the use of its subscription services.
5. Confidentiality. NAC Travel International will maintain the confidentiality of the client’s personal information and will not disclose it to third parties without the client’s prior written consent.
6. Termination of Services. NAC Travel International reserves the right to terminate its subscription services to any client at any time for any reason.
7. Governing Law. This Agreement and the relationship between the client and NAC Travel International shall be governed by the laws of the Republic of South Africa without regard to its conflict of law provisions.
8. Subscription Services. NAC Travel offers a range of subscription services to assist students with their study abroad needs. Each subscription is valid for a minimum tenure of 12 months. If a client wishes to cancel their subscription before the end of the minimum tenure, they must pay the full amount for the first year of the subscription. If a client breaches this clause, they will be required to pay the full amount for the first year of the subscription in addition to any penalties or fees incurred as a result of the breach.
9. Subscription Fees. The fees for NAC Travel’s subscription services are as follows:
   • Standard (SA): ZAR 250 per month
   • Standard (Non-SA): ZAR 500 per month
   • Premium: ZAR 750 per month
   • Platinum: ZAR 1000 per month
   • Executive: ZAR 1250 per month
   • VIP: ZAR 1500 per month
10. Waiving Deposits. Clients who wish to waive the R20,000 deposit required for NAC’s services must subscribe for a minimum period of 3 years.
11. Confidentiality. NAC will maintain the confidentiality of the Client’s personal information and will not disclose it to third parties without the Client’s prior written consent.
12. Termination. NAC reserves the right to terminate its services to any client at any time for any reason.
13. Limitation of Liability. NAC shall not be liable for any damages arising from the use of its services.
14. Governing Law. This Agreement shall be governed by the laws of the Republic of South Africa.
